Terms & Conditions of Purchase

These terms and conditions relate to any products supplied to you through this website (“the Site”) by Davina Combe Limited (“Davina Combe”, “we” or “us”) to you, the customer or Site user (“you”). These terms and conditions together with the receipt of order and despatch emails we send to you will form the agreement between you and us (“the Agreement”).

Please read these terms carefully to ensure you understand them. Before placing an order on this Site you will be asked to agree to these Terms. If you have any questions about these Terms, please contact us to discuss.

These terms and conditions may be varied by us at any time by posting amended terms and conditions on the Site. The terms and conditions which apply to your purchase will be those terms and conditions applicable at the time of the purchase.

These terms and conditions relate to your purchases from us through the Site but do not relate to your use of the Site otherwise. Please also see our Privacy and Data Protection Policy for information about how we collect and use your personal data and our Cookies Policy for information about cookies.

We are Davina Combe Limited and we operate and maintain the Site. We are registered in England and Wales under company number 10337350. VAT number 163390510. Our registered office address is at 34 Market Street, Bradford-On-Avon, Wiltshire, BA15 1LL UNITED KINGDOM.

Our Products

All items of jewellery available for sale on the Site are designed by Davina Combe. The jewellery is available in a range of materials including 18ct yellow gold vermeil, 18ct rose gold and sterling silver. Some designs may also be available to order in 9ct and 18 ct gold or in platinum.

‘Personalised Jewellery’ means any item of jewellery that is created by us in accordance with your specifications such as items with customised design, metals, stones, engravings, size, length or variation. For the avoidance of doubt this includes rings that are made to order to a specific size. Please check our product descriptions for further details as to whether an item is deemed to be Personalised Jewellery.

The images of the products on our site are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your device’s display of the colours accurately reflects the colour of our products. Your products may vary slightly from those images.

Availability

Any order you may place with us is subject to the availability of the products ordered. We cannot and do not guarantee that any item shown on the Site will be available continuously or at any given time.

We reserve the right to limit the amount of products that you order.

Placing an Order

Please view the Site which enables you to place an order. Our process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each page of the order process.

Payments for goods can be made by either credit or debit card online. You will have the option to choose which payment method you wish to use. Orders can also be placed over the telephone by calling us on +44 (0)20 3397 8402. Card details will be processed using our secure World Pay payment process. These Terms also apply to telephone orders.

At the time you place an order online you will be directed to a secure third party payment site (World Pay) and you will enter your card details. We may take payment from you at any time between you placing the order and us despatching the goods.

After you place an order, you will receive an email from World Pay acknowledging that your payment has been received. Once we receive your order, we will send you an email to acknowledge receipt of your order. However, please note that these emails do not mean that your order has been accepted.

If we are unable to supply you with a given item for an order, for example because that item is not in stock or no longer available or because we cannot meet your requested delivery date or because of an error in the price on our site, we will inform you of this by e-mail and we will not process your order. If you have already paid for the products, we will refund you the full amount charged as soon as possible.

We will confirm our acceptance of your order by sending you a confirmation e-mail confirming that the items have been despatched (“Confirmation”). The Contract between us will only be formed when we send you the Confirmation. All prices are expressed inclusive of any VAT payable unless otherwise stated. From January 2021, if you are ordering an item that will be shipped to an address outside of the UK, a sum equal to the applicable rate of VAT will be deducted from the total purchase price of the order.

Delivery

Delivery will be made to the address specified by you on the completed order form. When placing your order you can choose from a range of delivery options. Our delivery charges will be specified at the time the order is placed.

If we are unable to provide an exact date of delivery we will endeavour to provide you with an approximate delivery time when you place the order and we or our delivery partners will contact you again when we are able to specify a date.

Whilst we will use reasonable endeavours to deliver the items on the agreed date we will not be liable for any failure to deliver on the stated date or at the stated time.

With the exception of Personalised Jewellery, we will endeavour to deliver items ordered with our Standard Delivery time within the United Kingdom within 2–3 working days but we are not able to guarantee any specific delivery date. Items ordered with Next Day Delivery or Saturday Delivery must be ordered by 2pm. Items ordered with Same Day Courier must be ordered by 12noon. We will not be liable if we fail to deliver in part or in full due to circumstances beyond our control.

We will endeavour to deliver Personalised Jewellery within the United Kingdom within 4-8 weeks and we will provide you with an estimated delivery time when we send you our Confirmation. We will not be liable if we fail to deliver within the estimated time in part or in full due to circumstances beyond our control.

Our delivery requires a proof of signature and cannot be left for you without this. If you are not in at the specified delivery time, our delivery partner will leave a note informing you of how to rearrange delivery.

Repairs and Replacement Goods

If you receive your order and an item is damaged on receipt please email returns@davinacombe.com before returning the item. We will replace it at no additional charge or alternatively we will offer you a full refund for the cost of that item.

If an item that you have purchased through the Site becomes damaged within 6 months of the date of purchase as a result of a defect in the design, material and workmanship, or an item requires re-plating, we will repair or replace this item at no charge. The decision as to whether we repair or whether we replace the damaged item will be at our absolute discretion. You will be charged for the cost of any repairs to an item that have been in your possession longer than 6 months from the date of purchase. Please note, this guarantee does not apply to items of Davina Combe jewellery that have been purchased anywhere other than through the Site.

Please note you are required to inform us as soon as possible if your items are damaged or defective. Please see below for further details on how to exercise your rights if you receive an item that is damaged or defective.

If there is evidence that the damage to your item was caused as a result of your actions or neglect, we would be happy to repair the item for you, however you will have to pay for the cost of repair.

If an item you have ordered requires repair please let us know by contacting us via email at returns@davinacombe.com. Please provide your name (as placed on your order), the invoice number and the date of purchase in your email. We will inform you of any costs that you will be expected to pay for the repair. You will need to cover the postage costs.

Exchange of Goods

With the exception of Personalised Jewellery, we are happy to allow you to exchange any item that you have purchased from us, provided you notify us within 14 days from the date you received your order that you wish to exchange that item.

If you would like to exchange an item, you are responsible for paying the cost of returning the item to us and you will also be required to pay the delivery cost of the exchanged item (this will also apply in circumstances where the original order qualified for free delivery).

If the value of the exchanged item is lower than the original item purchased, we will refund the difference in price to you. If the value of the exchanged item is higher than the original item purchased, we will require payment of the difference in price before we can despatch the exchanged item to you.

If you wish to exchange an item, please let us know by contacting us via email at returns@davinacombe.com. Please provide your name (as placed on your order), the invoice number and the date of purchase in your email. We will inform you of any costs that you will be expected to pay including delivery costs.

Your Right to Cancel

You can cancel or change any of your current orders prior to despatch by contacting us via email at returns@davinacombe.com or by telephone on +44 (0)20 3397 8402.

Please see our returns and cancellation policy which explains your right to cancel a contract for the purchase of goods and how you can exercise that right. We will refund the full cost of the item(s) including the initial cost of delivery, except where you have chosen a faster delivery method than our Standard Delivery in which case we will refund you our Standard Delivery Charge. However you will bear the cost of returning the item(s) to us should you exercise your right to cancel.

Items of Personalised Jewellery may not be returned unless they are defective.

Under the Consumer Rights Act 2015 any products supplied must be as described, fit for purpose and of satisfactory quality.

If you wish to exercise your legal rights to reject faulty products you must tell us within a reasonable time of discovering the defect, and if the defect is reasonably apparent immediately then you must tell us within 30 days. You will then need to return the product in person or post it back to us. We will pay the costs of postage in this instance.

Our Liability

Where items are sold under a consumer transaction your rights which you are entitled to as a matter of law under the Consumer Rights Act or other legislation are not affected by any of these terms and conditions.

Any claim by you which is based on any defect in the quality of the products supplied or their failure to correspond with specification must be notified to us as soon as possible from the date of delivery (and in any case, within 30 days of delivery) or (where the defect or failure was not apparent on reasonable inspection) within a reasonable time after discovery of the defect or failure. If you do not notify us accordingly, you will not be entitled to reject the products and we shall have no liability for such defect or failure.

Where any valid claim in respect of any of the items supplied which is based on any defect in the quality or condition or their failure to meet its specification is notified to us in accordance with these terms and conditions we shall replace the items free of charge or refund to you the price of the item, but we shall have no further liability to you.

We shall not be liable to you by reason of any representation, or any implied warranty, condition or other term or any duty at common law, or under the express terms of these terms or this Agreement, for any consequential loss or damage (whether for lost profit, lost opportunity or lost reputation or otherwise), costs expenses or other claims for consequential compensation whatsoever (and whether caused by our negligence, our employees or agents or otherwise) which arise out of or in connection with the supply of products or their use or resale by you, except as expressly provided in these conditions.

Our entire liability under or in connection with these terms and conditions shall not exceed the price of the items supplied.

Nothing in this clause or any other of these terms and conditions will exclude or limit our liability in respect of death or personal injury caused by our negligence.

General terms

These terms and conditions and this Agreement will be subject to the laws of England and Wales. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so within the United Kingdom.

If you are not a consumer, you confirm that you have authority to bind any business on whose behalf you use our site to purchase products.

You may not transfer any of your rights under these terms and conditions to any other person. We may transfer our rights under these terms and conditions to another business where we reasonably believe your rights will not be affected.

If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations.

We shall not be responsible for any breach of these terms and conditions caused by circumstances beyond our reasonable control.
